A MAN is so furious about his neighbour’s leaves blowing into his garden that he is considering making them pay to clear them.
He shared his fury on Tiktok in a video that shows a sprawling tree and then pans down to show thousands of leaves in his his garden.
The tree is clearly encroaching over the fence and the wind appears to have blown the leaves over and onto his property.
But despite the nuisance this causes, legally the man can’t do anything about it.
This is because the law in both the UK and the US views the debris as the responsibility of the person who’s property they land on.
However there is a slight difference between the law on leaves in the UK and the US.
According to FindLaw, in America Leaves are considered “a natural product.
“Even if the leaves cause damage, like clogging your gutters or pipes, you have no legal claims against the owner of the tree.”
But in the UK, the Royal Horticultural Society advises if damage occurs as a result of debris then the tree owner should be notified.
The only action that can be legally taken is to trim branches that overhang onto a property, but this doesn’t solve the issue of the wind blowing the leaves over.
This is not the first time a dispute like this has occurred, recently a homeowner decided to take drastic measures after his neighbours tree kept dropping cherries into his yard.
Jake Fletcher decided to cut half of the tree off, in a move that has divided opinion on TikTok, even as he said it was his “legal right” to do so.
Some supported Jake and said he had “every right” to chop the tree, but most disproved and one called it a “rotten thing to do”.
Similarly there was another leaf drama when a woman’s neighbour was so angry with her over-hanging trees that he throws leaves into her yard every year.
